7.3 Development control and appeals notes
5 notes, in reading order.
- 7.3.1MRTP Act Sections 43–44: restriction on development and application for permission, including integrated townships
Section 43 bars anyone from developing land or changing its use in a DP area without the Planning Authority's written permission, from the day the intention to prepare a DP is published; section 44 says how a private person applies, and s.44(2) lets large township projects apply straight to the State Government.
Standard · 8 min · Full course - 7.3.2MRTP Act Sections 45–46: grant or refusal of permission, deemed permission and matters to be considered
On an application under s.44 the Planning Authority must grant, grant with conditions, or refuse permission in writing with reasons; if it stays silent for sixty days the permission is deemed granted, but only for a proposal that fully conforms to the DCR and plans; and in every case it must have regard to the draft or final plan (s.46).
Standard · 7 min · Full course - 7.3.3MRTP Act Section 47: appeal against orders on development permission
An applicant unhappy with a Planning Authority's refusal or conditional grant of permission under s.45 can appeal within forty days to the State Government or an officer of at least Deputy Secretary rank, who after hearing both sides may dismiss the appeal or grant permission with or without modified conditions.
Standard · 6 min · Full course - 7.3.4MRTP Act Sections 48 and 51: lapse of permission and revocation or modification with compensation
A development permission lives for one year and can be stretched year by year to at most three more years, after which unstarted work needs fresh permission (s.48); separately, a Planning Authority may revoke or modify a permission in the interest of the DP before work has gone far, paying compensation for expenditure wasted (s.51).
Standard · 7 min · Full course - 7.3.5MRTP Act Sections 52–58: unauthorised development, penalty, compounding (s.52A), removal and development by Government
Sections 52–57 give the Planning Authority a ladder of powers against development done without or against permission (prosecution, restoration notice, stop-work notice, summary removal of temporary structures), s.56 lets it remove even authorised uses with compensation, s.52A allows compounding of older unauthorised structures, and s.58 sets a separate route for Government's own development.
