15.3 RFCTLARR Act 2013: compensation and R&R notes
5 notes, in reading order.
- 15.3.1RFCTLARR Section 26: market value of land and the material date
Under s.26 the Collector fixes market value as the highest of three figures — the stamp-duty value, the average of the top half of sale prices of similar land in the vicinity over the preceding three years, and the consented amount for private or PPP projects — as on the date of the s.11 preliminary notification, and then multiplies it by the First Schedule factor.

s.27 makes compensation the market value (multiplied by the First Schedule factor) plus all assets attached to the land, and s.28 lists seven heads the Collector must weigh — market value, crops and trees, severance, injurious affection, cost of shifting, loss of profits and any equitable ground.

The Collector values buildings, trees and crops on the land with experts (s.29), adds a solatium of 100% of the compensation for the compulsory nature of acquisition (s.30(1)), and pays an additional 12% per annum on the market value from the SIA notification (s.4(2)) to the award or possession, whichever is earlier (s.30(3)).

Every compensation sum follows one order — market value (highest of s.26 criteria) × factor + assets = compensation; + 100% solatium; + 12% p.a. on market value from SIA notification; then interest at 9%/15% for late payment — and most exam errors come from applying a percentage to the wrong base.

Besides compensation, every affected family gets an R&R award (s.31) from the Second Schedule — house, land or developed land, job or Rs 5 lakh or an annuity, and cash allowances — and resettlement areas get the Third Schedule amenities; s.41 adds protections for Scheduled Areas, SCs and STs, and ss.43–50 set up the Administrator, Commissioner, R&R Committee (100 acres or more) and monitoring committees.
